so im browsing around on myspace tonite and i find an account for a band called "death notes for dehlia" ...now if you know anything about my band Dour Cursiva (not that i expect you to, but apparently these kids do) this is a rip off of the name of one of our old songs called "gracenotes for delhia".

notice that they not only ripped us off, but they cant spell dehlia right. i wonder if thats their way of avoiding legal issues. but im not really sure what to do here. maybe there a tribute band. haha! check it out here... http://www.myspace.com/dehliasdeathnote

I used to do vocals for a band called A TRAGEDY UNVEILED and we had a song titled "Inanna", after that song appeared on a few compilations a band comes out named INANNA UNVEILED.

Who knows?

haha.

toggletoggle post by cav nli at Sep 5,2005 3:27am
and aparently i cant spell it right either...delia. haha

toggletoggle post by SacreligionNLI at Sep 5,2005 4:09am
bah that happens all the time

we wrote a song called wages of sin and sure enough we found out that its the title of an arch enemy song...we didn't bother to change it

anyhow, what i mean is that a lot of things have been done over our history as people...you're bound to find similarities in your art to someone else's...all that matters is the feeling behind it

toggletoggle post by SacreligionNLI at Sep 5,2005 4:09am
p.s.

i'm fuckin trashed

toggletoggle post by SacreligionNLI at Sep 5,2005 4:10am
p.p.s.

toggletoggle post by the_reverend   at Sep 5,2005 4:17am

toggletoggle post by the_reverend   at Sep 5,2005 4:17am

haha

sent from the band who did the copying:

This is what I sent them, maybe it can tell the story. But basically a freind came up with the band name at practice and we liked it... We were unaware that Dour Cursiva used the title.. We just heard it from our friend Josh and liked it. We are changing our name now.. Its tough enough as it is to keep origionality, and we would be pissed if someone was to rip us off as well..-Sean

To Dour Cursiva: Oh man.. I'm sorry guys.. I just read what you sent and I feel like such a shithead. Sorry we werent trying to steal any titles or anything.. We were just looking for a name and a friend of ours came to one of our practices and we were throwing around names for the band.. Sorry we never really asked about it, we just liked it from the beginning. Sorry and all tho were not pirates and I don't want the band to get a reputation or anything.. unless we decide to wear eyepatches and stuff. Sorry for the whole thing... It was a concept name to begin with so we'll gladly change the name in no time.. I had a few I liked.. Again wicked sorry. Theres a million bands and a million songs and you don't think twice to check something out when you hear a good name.. Hope there isnt any bad blood you guys are sick.. I just listened to some stuff.. and I'm impressed.. IT would be an honor to play with you guys sometime.. - Sean

toggletoggle post by cav nli at Sep 6,2005 12:05am
they already changed their band name.

Speaking of rip-offs, this is so similar, I had to splice them together so you could hear it easily.

who cares if they use a song title to name the band. there's like 10 bands named after carcass songs (carnal forge, etc.). i could see if it were a direct rip-off or very similar to your band name, but song titles are not that big a deal.

toggletoggle post by brian_dc  at Sep 6,2005 1:55pm
yeah, I thought nothing of it...which is why I stayed out of it entirely.

a friend of TYAG let us know that there is a band on myspace called "1000 machines eat my flesh" or something to that effect...they stole the mp3 of our song "rotted entrails gagged by semen" and put it up on their site as "slash and gash cum..." something or other. they haven't responded to our messages and haven't even been online according to myspace for like a month and a half, so i'm guessin it's just some stupid kids playing a joke. but still, if that was legit, macabre mementos records would flip their shit and get tons o' money, haha

toggletoggle post by succubus  at Sep 6,2005 2:17pm
mark, you just need to contact myspace and they will delete the account for you...just explain the situation and give them all relevant info and proof and they'll take down their page

toggletoggle post by mark fucking richards at Sep 6,2005 2:25pm
weeerrrd up, thanks carina...

by the way, the band and i will be talking thursday night about when we can get promo pics done at our space when there is NO game goin on. we still want the live pics from the neuraxis show if you can still do it, just so there's no confusion
